Manchester Woman Hit With Baseball Sues Little League Player
Seeking more than $15,000 for damages to cover medical expenses that stemmed out from an incident in a Little League game in Manchester, New Jersey two years ago, a woman is now suing the young player who threw the ball.
The woman identified as Elizabeth Lloyd is also suing for pain and suffering. Lloyd was sitting at a picnic table near a bullpen when she was hit by a baseball thrown by catcher Matthew Migliaccio who was warming up another player that time. Migliaccio was still 11 years old during the incident.

Lloyd filed suit on April 24 alleging that the catcher’s throw was intentional and reckless, that it had “assaulted and battered” and caused her painful and permanent injuries.
The lawsuit also declared that Lloyd continues to suffer pain and has been incurring medical expenses, and that she has been incapacitated to do her usual duties. The claimant also alleged that the young player’s actions were negligent and careless as he engaged in an inappropriate activity near her. Another lawsuit filed by Lloyd’s husband is suing the boy for her wife’s loss of “services, society and consortium.”
The Migliaccios through their lawyer, Anthony Pagano, viewed the lawsuit as frivolous and without merit. The suit for negligence and carelessness according to Pagano can be covered by homeowner’s insurance, but the other counts are not.
On the other hand, the Little League denied any coverage. According to their spokesman, Steve Barr, each Little League is required to have accident insurance. However, this only covers the players, coaches, and concession stand workers but not the spectators.
